Delhi courts have clarified that orders passed by the Delhi Medical Council (DMC) Disciplinary Committee are not binding on judicial forums. While the DMC is authorized to regulate professional conduct and orality of medical practitioners, its disciplinary decisions do not erode the authority of courts.

The council’s role is widely regulatory and advisory, aimed at maintaining medical standards and professional accountability. However, when conflicts reach courts, judges independently assess the facts, evidence, and applicable laws. Courts are not legally compelled to enforce or follow DMC disciplinary findings.

This distinction protects judicial independence and ensures that doctors and complainants alike receive fair adjudication under law. DMC orders may be considered as expert opinions, but the final decision rests wholly with the courts.

The clarification reinforces the balance between medical self-regulation and judicial oversight, ensuring responsibility without compromising due process.
