In a significant judgment reinforcing the importance of healthcare access, the Chhattisgarh High Court has ruled that the right to life under Article 21 of the Constitution includes the right to timely medical treatment. The court emphasized that delayed medical care can directly threaten a person's life and dignity, making prompt treatment a constitutional obligation.

 

The ruling came while hearing a case related to the medical condition of a prisoner. The court observed that inmates, despite being in custody, do not lose their fundamental rights. Authorities are therefore responsible for ensuring that prisoners receive necessary medical attention without unnecessary delay.

 

During the proceedings, the High Court stressed that the **“Right to Life” guaranteed by the Constitution of India is not limited to mere survival but also includes the right to live with dignity and access essential healthcare services. If medical treatment is delayed or denied, it can amount to a violation of constitutional rights.

 

The court also directed prison authorities and the state government to ensure a time-bound decision on parole requests when medical treatment is required. In the case under consideration, the High Court ordered that the authorities must decide on the prisoner's parole plea within ten days, recognizing that urgent medical needs cannot be ignored due to administrative delays.

 

Legal experts say the judgment reinforces a long-standing judicial principle that healthcare is an integral part of fundamental rights. Courts in India have repeatedly held that the state has a duty to protect the life and well-being of every individual, including those in custody.
